Terms of Service — Casino Tax Recovery
These Terms of Service (“Terms”) govern your use of the services provided by Casino Tax Recovery (“we,” “us,” or “our”) and your access to the casinotaxrecovery.com website. By engaging our services, you agree to these Terms in full. Please read them carefully.
1. Services
Casino Tax Recovery provides a private tax filing service to assist non-resident individuals in recovering U.S. casino withholding tax through IRS Form 1040-NR. Our services include:
- Assessment of eligibility under applicable U.S. tax treaties
- ITIN (Individual Taxpayer Identification Number) application assistance
- Preparation and submission of IRS Form 1040-NR
- Document review and IRS correspondence on your behalf
- Status updates throughout the refund process
Casino Tax Recovery is a private tax filing service. We are not affiliated with, endorsed by, or acting on behalf of the IRS or any government agency. We do not provide legal advice or legal representation.
2. Fees
Our service fee is $199 CAD (or as agreed in writing), charged on a contingency basis:
- No fee is charged upfront or before your refund is issued
- The fee is due upon confirmation that the IRS has issued your refund
- If no refund is issued by the IRS for any reason, no fee is charged
- Partial refunds — if the IRS issues a refund in any amount, the full service fee applies
Fees are exclusive of any applicable taxes. Casino Tax Recovery reserves the right to adjust service fees. Any changes will be communicated in writing prior to engagement.
3. Refund Policy
Because our fee is contingency-based and only collected upon successful refund recovery, refunds of the service fee are not available once the IRS has confirmed issuance of your refund. If you believe a fee was charged in error, please contact us within 30 days.
We do not guarantee any specific refund amount or outcome. Eligibility and refund amounts depend on individual circumstances, IRS processing, applicable treaty provisions, and supporting documentation. Results may vary.
4. Client Obligations
By engaging our services, you agree to:
- Provide accurate and complete information including correct identification documents
- Supply all required W-2G casino withholding documents in a timely manner
- Respond promptly to requests for additional documentation
- Notify us of any change in contact information or circumstances
- Not engage any other tax filing service for the same claim without written notice to us
5. Limitation of Liability
Casino Tax Recovery shall not be liable for:
- IRS decisions, delays, or denials outside our control
- Refund amounts that differ from estimates provided
- Losses resulting from inaccurate or incomplete information provided by the client
- Delays caused by IRS processing times, government shutdowns, or force majeure events
- Indirect, incidental, or consequential damages of any kind
Our total liability to you for any claim arising from our services shall not exceed the amount of the service fee paid by you.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. By using our services, you consent to this jurisdiction and waive any objection to venue in Ontario.
7. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
